Experts from political manifesto jointly disagreed the statement of Chief Justice Maria Lourdes Sereno saying that there's no way that the Quo Warranto filed by Solicitor General Jose Calida can oust her from the Supreme Court.
Weeks earlier, Sereno made an statement that the petition filed is unconstitutional since the supreme court is an independent body and only the impeachment decision by the Senate have the authority to removed her from her post.
Contrary, experts believed that Quo Warranto petition is enough and right to oust a government official even a Chief Justice in the Supreme Court. As, professor in Remedial Law Tranquil Salvador said Rule 66 Section 1 (b) of the Rules of Court can apply to Sereno stated that “who does or suffers an act which, by the provision of the law, constitutes a ground for the forfeiture of his office.”
Butch Jamon, professor in Political Law stated “Quo warranto can be filed in the Supreme Court and it is the mandate of the Supreme Court to resolve such [a] petition.”
