The Supreme Court (SC) said that the "hold departure order" issued by then Secretary of Justice Leila De Lima over former President Gloria Macapagal Arroyo is "unconstitutional". The SC affirmed that the circular stopping Arroyo to leave the country is against the law provided in the Article III, Section 6 of the 1987
Constitution, the right to travel.
“The Court, in interpreting Article III, Section 6, determined that there was no legal basis for Department Circular No. 41 because of the absence of a law authorizing the Secretary of Justice to issue Hold Departure Orders (HDO), Watchlist Orders (WLO) and Allow Departure Order (ADO),” the high court said.
Associate Justice Andres Reyes Jr. said the issuances released by Sen. Leila De Lima during her seat as justice secretary were null and void.
